Abstract

The past half a decade has seen a tremendous growth in the adoption of artificial intelligence technologies by average everyday individuals. This mass adoption raises novel legal questions vis-à-vis existing copyright regulations in Nigeria. Particularly, this article analyzes three key questions. First, whether AI generated content infringes on the copyright in works used in such AI system’s training. Second, who copyright in AI generated content vests, and third, who should be held liable when such content infringes on pre-existing copyright.

On the first question, this article argues that in majority of cases, AI generated content does not infringe on the copyright of authors. On the second question, it argues that AI generated content cannot be afforded copyright protection since authorship vests in the AI system, a non-juristic person. Lastly, on the third question, it argues that
creators of AI systems should be held liable for copyright infringement orchestrated by such systems.
